ACCEPTANCE OF TERMS

This site is owned and operated by Supplybase Enterprises LLP, hereafter www.supplybase.net, and provides its services to you subject to the following conditions. If you visit or shop at www.supplybase.net, you affirmatively accept the following conditions.

You must read, agree with and accept all of the terms and conditions contained in this ToU and our Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may use any services.

DESCRIPTION OF SERVICES

www.supplybase.net provides you with access to a variety of resources, including the purchase and sale of virtual items (accounts), and sale or display of gaming guides (collectively "Services"). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to the ToU.

PERSONAL AND NON-COMMERCIAL USE LIMITATION

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not use for any commercial purpose, disclose, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services (for example you may not re-sell any of our guides).

PRIVACY AND PROTECTION OF PERSONAL INFORMATION

Our collection and use of your information is set forth in our Privacy Policy. By accepting these ToU, you also specifically agree to the terms and conditions of our Privacy Policy.

NOTICE REGARDING TITLE TO INTERACTIVE ITEMS AND ACCOUNTS

The material in this site are provided "as is" and without warranties of any kind either expressed or implied. To the fullest extent permissible pursuant to the applicable law, www.supplybase.net disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for particular purpose. In regards to all virtual goods and services www.supplybase.net is only providing a service to buyer; no goods or property are being sold to buyer by www.supplybase.net. www.supplybase.net makes no representations regarding the transferability, use, and ownership of intellectual property. Once payment is received and the services are performed, buyer shall take the place as a user of intellectual property, but only to the extent permitted by the EULA.
No Funcom employees are permitted to purchase from this website or from us by any method. Buyer wholly assumes all risks and agrees to defend, hold harmless, and indemnify www.supplybase.net for any claims in relation to this transaction and the use of intellectual property.
Special notice regarding purchases of accounts - anytime you buy an account, from ANY source, there is always an inherent risk. www.supplybase.net does its best to ensure the security of every account; however, people can, and do, steal back accounts or get them banned. This happens very rarely on accounts available from www.supplybase.net, but it does happen.
Buying an account is typically a great experience as you get the chance to play another class, usually at a higher level, and the time savings are immense. In order to protect yourself, once we have sold you the account, you will want to change the password and billing. You are entirely responsible for maintaining the confidentiality of your password and other account information. If you aren't the original owner of an account, never leave anything on it that you aren't willing to lose. This minimizes your risks. The chances this happens are less than 1% but we want to make sure that you understand the risk.
As set forth in detail below, all accounts are sold “AS IS” and we can offer no guarantees on them whatsoever, other than the account info we provide will work when the account is delivered and we’ve done our best to ensure its sanctity.

INDEMNIFICATION

You agree to indemnify and hold www.supplybase.net harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or any terms and conditions it incorporates by reference, or your violation of any law or the rights of a third party.

REMEDIES

You acknowledge that violation of this Agreement could cause irreparable harm for which monetary damages may be difficult to ascertain or an inadequate remedy. You therefore, agree that www.supplybase.net shall be entitled, in addition to its other rights, to seek and obtain injunctive relief for any violation of this Agreement without the filing or posting of any bond or surety. Furthermore, in the event a lawsuit or action is brought by any party under this Agreement to enforce any of its terms, it is agreed that if www.supplybase.net shall be deemed to be the prevailing party as determined by final judgment, not subject to appeal, of a court of competent jurisdiction, www.supplybase.net shall be entitled to recovery of reasonable attorney's fees, expert fees, litigation expenses and court costs in addition to any other relief granted by the court.

ADDITIONAL TERMS

Any access to or use of the www.supplybase.net shall be deemed your agreement to and approval of all the terms and conditions contained in this Agreement and our Privacy Policy. In addition, when using particular services on www.supplybase.net, you agree that you are subject to any posted policies or rules applicable to the services you use, which may be posted from time to time. All such posted policies or rules are hereby incorporated by reference into this Agreement.
